Article 26 The employer shall carry out routine monitoring of occupational-disease-inductive factors by specially-assigned personnel and ensure the normal operation of the monitoring system.

The employer shall, in accordance with the regulations of the public health authority under The State Council, conduct regular testing and evaluation of the occupational-disease-inductive factors in the workplace. The test and evaluation results shall be stored in the occupational health archives of the employing units, which shall be regularly reported to the local administrative department of public health and publicized to the workers.

The testing and evaluation of the occupational-disease-inductive factors shall be conducted by the occupational-health technical service institutions established according to law and approved by the public health authority under The State Council or the public health authority under the people's government at or above the city divided into districts according to the division of functions and duties. The testing and evaluation made by the occupational health technical service institutions shall be objective and true.

If it is found that the occupational-disease-inductive factors in the workplace do not meet the national standards and requirements of occupational health, the employer shall immediately take corresponding measures to control the situation. If the occupational-disease-inductive factors still fail to meet the national standards and requirements of occupational health, the employer must stop the operations with occupational-disease-inductive factors. After the occupational-disease-inductive factors are controlled, the operation can be resumed only if the occupational-disease-inductive factors meet the national standards and requirements of occupational health.

Article 20 If the occupational-disease-inductive unit is seriously involved, it shall entrust a qualified occupational health technical service institution to carry out at least one occupational-disease-inductive test every year.
